1. Acceptance & Enterprise Agreement
By creating a Kaamyatri account, executing an Enterprise Master Services Agreement (MSA), or accessing any module within the platform (including Core HR, Payroll, ATS Requisitions, and Performance OKRs), your organization ("Customer" or "Subscriber") agrees to be bound by these Terms of Service.
If you are entering into these terms on behalf of a company, organization, or legal entity, you represent and warrant that you have full authority to bind such entity to these legal obligations.
2. Authorized Platform Usage
Kaamyatri grants Customer a non-exclusive, non-transferable, worldwide license to access and utilize the subscribed workforce modules during the active subscription term.
- System access is limited to Customer's active workforce headcount tier as defined in your Order Form.
- Customer shall not reverse engineer, decompile, or attempt to extract source code from the Kaamyatri engine.
- Customer is responsible for maintaining the confidentiality of all administrative API keys and OAuth credentials.
3. Multi-Tenant Data Isolation & Security
Kaamyatri enforces zero-trust multi-tenant data architecture. Customer data is stored in logically isolated database schemas with 256-bit AES encryption at rest and TLS 1.3 encryption in transit.
Kaamyatri undergoes annual third-party SOC2 Type II compliance audits and maintains ISO 27001 certification standards across all cloud infrastructure nodes.
4. Payroll, PF & Statutory Filings
Kaamyatri provides automated calculation and disbursal APIs for Monthly Gross-to-Net Payroll, Employees Provident Fund (EPF), Professional Tax (PT), Employee State Insurance (ESI), and Tax Deducted at Source (TDS Form-16).
While Kaamyatri automates calculations based on current statutory rules, Customer remains legally responsible for verifying final disbursal figures and ensuring corporate bank accounts are adequately funded prior to scheduled pay cycles.
5. SLA & 99.99% Uptime Guarantee
For Enterprise Tier subscribers, Kaamyatri guarantees a Service Level Agreement (SLA) of 99.99% operational uptime per calendar month, excluding scheduled maintenance windows announced at least 72 hours in advance.
6. Data Retention & Offboarding
Upon subscription termination, Customer may export all employee records, payroll ledgers, and audit logs in JSON/CSV formats for up to 90 days. After 90 days, Customer data is securely purged in compliance with SHA-256 data destruction standards.
7. Limitation of Liability
To the maximum extent permitted by applicable law, neither party shall be liable for indirect, incidental, special, or consequential damages resulting from platform usage or downtime.
8. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of these terms shall be subject to binding arbitration in Mumbai under the Arbitration and Conciliation Act.
